Anima Yachting informs you that during the provision of its services (your journey) will record photos and videos for marketing purposes. These photos and videos can be used to provide information, promote the services offered by Anima Yachting and increase visibility of the company, and shall be posted on the social media accounts that Aniam Yachting maintains on Facebook, Instagram, TikTok, LinkedIn and YouTube.

Anima Yachting uses the appropriate and lawful practices to protect the interests and fundamental rights and freedoms of individuals. In general, Anima Yachting will take the outmost effort to avoid capturing faces or other characteristics that can easily be used to identify a natural person (our guests). Our goal is not to record any specific person, as photos and videos are intended to advertise the overall experience one can gain via our services and for the other purposes listed above. However, we understand that your image may be recognizable, which is why we provide you with this Privacy notice to inform you about how Anima Yachting processes photos or videos that may include your image.

What is the legal basis for processing your data? The taking of photos and videos is done in accordance with the legal basis of “legitimate interests”. This means that Anima Yachting Anima Yachting benefits from the ability to record events to provide information and promote its services and that we may use your photos to do this, as long as this does not infringe upon your fundamental rights and freedoms.

How do we use your data? Your image can be used in printed media produced by Anima Yachting, such as newsletters, guides and promotional /informational brochures, stand-alone or included in magazines/newspapers. Photos and videos may also be used on websites or social media operated by Anima Yachting or affiliated organizations. This content may be available to the general public at any time in the future.

Who has access to your data? Published photos and videos are available to anyone who has access to the website, social media channels and printed materials on which the photos or videos appear. Original photos and videos will only be accessible to authorized employees, or third parties who process data on behalf of Anima Yachting (e.g. print providers, digital asset management suppliers, photographers, production companies, advertising agencies) who are contractually bound by a duty of confidentiality.

How do we keep your data safe? Anima Yachting takes information security seriously and has implemented appropriate technical and organizational measures to protect personal data and special categories of personal data. Access to information is restricted on a need-to-know basis and security arrangements are regularly reviewed to ensure its continued relevance.

International Data Transfers (outside the European Economic Area). We do not intend to transfer your personal data outside the European Economic Area. However, we may use a service provider (e.g. website provider) located outside the European Economic Area. In such a case, all appropriate measures are taken to ensure that any transfers to 3rd parties outside the European Economic Area comply with the legal and regulatory provisions of the GDPR and applicable local law as amended from time to time.

How long will we keep your data? Anima Yachting will retain your data in accordance with legal requirements or where there is a business need. In general Anima Yachting will retain the data until you declare that you object to the processing.

What rights do you have in relation to your data? Under the General Data Protection Regulation (GDPR), you have the right to access your data, the right to rectification, erasure (in certain cases), restriction of processing, objection or portability (in certain cases). You also have the right to withdraw consent (where applicable).

Object to the processing (Opt out of Event Photography or Videography). If you participate in an event/journey where photos or videos can be taken, you can let us know and we will do our best not to record or retain images or footage of you. You can, if you wish, let us know in advance by emailing info@animayachting.com before you embark on the journey stating which journey/event you will be participating in and the dates/times. If you were unable to inform us in advance or have any questions or concerns, please contact the company’s agent or the photographer or videographer on the spot. Even after the event, you can always let us know to stop using and remove your image. Please note that although we will stop using your image in any future postings, we will not be able to remove any printed material that have already been published. In addition, due to existing technological capabilities or limitations, Anima Yachting, at your request may remove and delete the material form the official social media sites of the Company but is unable to guarantee removal from other sites where the material may have been copied in the meantime by third party.
